1. Who we are

SunsetVue ("SunsetVue", "we", "us") is a web application operated by Maciej Karpinski, Arnistrasse 5, 8908 Hedingen, Switzerland. Contact: sunsetvueapp@gmail.com.

These Terms of Service ("Terms") govern your use of the SunsetVue website and application (the "Service"). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

2. What the Service does

SunsetVue provides predictive quality scores for sunrises and sunsets based on publicly available meteorological data. The Service samples weather conditions at multiple geographic points along the sun's azimuth path and produces a score and a suggested verdict (for example: GO, MAYBE, SKIP), together with supporting data such as cloud cover, cloud base height, and terrain context.

3. The forecast is a prediction, not a fact

This section is important. Please read it.

  • Sunset and sunrise quality predictions are inherently uncertain. They are derived from third-party weather models that are themselves probabilistic and frequently wrong.
  • A GO verdict is not a guarantee of a good sunset. A SKIP verdict is not a guarantee of a bad one.
  • Scores, verdicts, cloud data, elevation data, and terrain visualisations are provided for informational purposes only and must not be relied upon as the sole basis for any decision.
  • Every recommendation must be assessed personally by you. A score, verdict, or recommendation is one input among several. Before acting on it you must apply your own judgement, your local knowledge, current official forecasts and warnings, and your own observation of the actual conditions. We do not make decisions for you and none of our output is an instruction to go anywhere or to do anything.
  • The Service does not account for terrain occlusion in its scoring, does not assess trail conditions, avalanche risk, rockfall, weather hazards, daylight remaining, or the physical accessibility or safety of any location.

4. Your safety is your responsibility

Landscape and nature photography frequently involves travel to remote, elevated, or hazardous locations, often in low light.

You are solely responsible for your own safety and for every decision you make about where and when to go. Before travelling to any location you must independently check official weather warnings, mountain and avalanche bulletins, trail and road conditions, sunset and civil twilight times, and your own equipment, fitness, and experience. Where relevant, consult official Swiss sources such as MeteoSwiss and the SLF avalanche bulletin, or the equivalent authorities in your country.

In particular, assessing the risks of a trip, planning it, and safeguarding yourself while on it are yours alone. That includes judging whether the conditions, the route, the timing, the light, and your own equipment, fitness, and experience are within your limits, and deciding whether to go at all, to turn back, or to abandon a shot. It also includes the safety of anyone you take with you.

We are not a guide service. We do not assess, and do not represent, any location as safe, accessible, legal to enter, or suitable for you.

5. Accounts

  • You must be at least 16 years old to create an account.
  • You are responsible for the accuracy of the information you provide and for all activity under your account.
  • Authentication is handled by our identity provider (Clerk). You must keep your login credentials and email inbox secure.
  • We may suspend or terminate accounts that breach these Terms, abuse the Service, or attempt to circumvent usage limits.

6. Subscriptions, plans, trials, and payment

What a plan includes. The features and usage limits included in a plan are the ones shown in the plan description presented to you immediately before you subscribe. The price, billing period, and any trial or introductory terms are shown before purchase and at checkout. That plan description and checkout information form part of your agreement with us together with these Terms. A plan description may cover, for example, saved-location limits, forecast allowances, outlook or timeline length, and whether alerts or background monitoring are included. A feature is not included in a plan unless its description says that it is.

Improvements and future offers. We may add features, increase limits, or otherwise improve a plan without updating these Terms or charging you extra. We may also change, replace, or stop offering plans for future purchases. The description shown before a future purchase or plan change governs that purchase or change.

Changes to an active subscription. We may modify the Service during an active subscription for a valid reason, including security or legal requirements, adapting to a new technical environment or increased use, changes in third-party service availability, preventing abuse, or other important operational reasons. Any modification under this paragraph will be made without additional cost and explained clearly. If a modification would negatively affect your access to or use of the Service in more than a minor way, we will notify you reasonably in advance by email or another durable medium, describe the nature and timing of the change, and explain any right you have to terminate without charge. Where applicable law gives you that right, you may exercise it within 30 days after the later of receiving the notice or the modification taking effect. This does not apply where we let you keep the unmodified Service at no additional cost and it remains in conformity with our agreement. Your mandatory statutory rights remain unaffected.

For a price increase or a material reduction that is to apply from a later renewal period, we will notify you before that renewal. You may cancel before the change takes effect. Changes that only improve your plan do not require this notice.

Legacy access. A plan or account state that is no longer offered may remain available to existing users. Its current features and limits are the ones described in the applicable account or plan information. Stopping new sales of a plan does not by itself end an existing subscription.

Trials. If we offer a trial, the checkout page states its eligibility rules, duration, whether a payment method is required, and the price and billing period that will apply afterwards. Unless checkout expressly says otherwise, a trial converts automatically to a paid, renewing subscription when it ends. You can cancel before the first charge. We may limit trials to one per person, account, or payment method.

Payment, renewal, and cancellation.

  • Payments are processed by Stripe. We do not receive or store your full card details.
  • Prices shown at checkout include applicable VAT or sales tax.
  • A subscription renews automatically for successive billing periods until cancelled. You may cancel from your account settings or billing portal; cancellation takes effect at the end of the current billing period, and paid access continues until then.
  • If payment fails, we may retry it and may limit or suspend paid features. Ending paid access does not by itself delete your account; account data remains subject to the Privacy Policy and your account controls.
  • We may send transactional account, security, billing, and legally required messages. These are separate from optional forecast or weather notifications, which are available only if the applicable plan description and your settings enable them.
  • Except where required by law, fees already paid are non-refundable. We may, at our discretion, offer a refund.

EU/EEA consumers — right of withdrawal. If you are an EU/EEA consumer, applicable law generally gives you 14 days to withdraw from a distance contract for services. Any trial or contractual cancellation right shown at checkout is additional and does not limit that statutory right. By subscribing, you ask us to begin supplying the Service immediately. We will handle any charge, proportionate payment, or refund following a valid withdrawal as required by applicable law.

7. Advertising

SunsetVue does not display advertising and does not load Google AdSense. If advertising is introduced later, these Terms and the Cookie Policy will be updated before ads are displayed.

8. Acceptable use

You may not:

  • scrape, crawl, or systematically extract data from the Service;
  • use automated means to exceed usage limits, or create multiple accounts to do so;
  • resell, sublicense, or redistribute forecast outputs as a competing product or service;
  • reverse engineer the scoring model, or attempt to gain unauthorised access to our systems;
  • upload unlawful content or use the Service to harm others.

9. Intellectual property

The Service, including its scoring methodology, code, design, and branding, is owned by us and protected by copyright and other laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for your personal or internal professional photography purposes.

Underlying weather, map, place-search, and elevation data is provided by third parties (including Open-Meteo, OpenStreetMap, Photon, and AWS Terrain Tiles) and remains subject to their own terms and licences.

10. Third-party services and availability

The Service depends on third-party APIs and infrastructure. We do not guarantee that the Service will be available, uninterrupted, timely, or error-free. We may modify, suspend, or discontinue parts of the Service subject to section 6 and your mandatory statutory rights. If we discontinue a paid feature for a period you have already paid for, we will either preserve access to the agreed Service or refund the affected unused portion of your subscription on a pro-rata basis, as applicable.

11. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including any warranty of accuracy, fitness for a particular purpose, or non-infringement.

12. Limitation of liability

To the maximum extent permitted by applicable law:

  • We are not liable for any loss, injury, damage, cost, or missed opportunity arising from your reliance on a forecast, score, or verdict, or from any journey or activity you undertake.
  • We accept no responsibility for harm to health — yours or anyone else's — or for damage to, or loss of, property or equipment, where it is caused by weather, terrain, darkness, water, cold, or any other natural condition encountered on a trip you chose to make. This applies whether or not our forecast turned out to be accurate.
  • We are not liable for indirect, incidental, consequential, or special damages, or for lost profits, lost data, or wasted expenditure.
  • Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) CHF 50.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our gross negligence or wilful misconduct, or any other liability that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights are unaffected.

13. Indemnity

You agree to indemnify and hold us harmless against claims, damages, and costs arising from your breach of these Terms or your misuse of the Service.

14. Changes to these Terms

We may update these Terms. If a change is material, we will notify you by email or in-app at least 14 days before it takes effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree, you may cancel your subscription and stop using the Service.

15. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms. On termination, your right to use the Service ends immediately; sections 3, 4, 9, 11, 12, 13, and 16 survive.

16. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Hedingen, Switzerland.

If you are a consumer resident in the EU/EEA, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of your country of residence, and you may also bring proceedings in the courts of your country of residence.

17. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
